Construction and Infrastructure

• Representation of the concessionaire of U-Tapao International Airport, which is the first international airport concession project in Thailand and the highest -valued PPP project. The project involves the development of new airport facilities, including a large, advanced terminal with new technology, cargo facilities, a cargo village, and improvements of runways and taxiways. The estimated value of this concession is THB 300 billion (USD 10 billion).
• Representation of the concessionaire of the first airport city in Thailand to be located at U-Tapao International Airport. Once completed, the Eastern Airport City will become a regional aviation hub, tourist destination, and logistics center in Thailand.
• Representation of the government agency in connection with the preparation on bidding documents, including the preparation on the Request for Proposal (RfP), and drafting and negotiation on the concession contract of the U-Tapao international airport with the value of the concession is of THB 300 billion (USD 10 billion).
• Representation of the government agency in connection with the preparation on bidding documents, including the preparation on the Request for Proposal (RfP), and drafting and negotiation on the concession contract of the high-speed railway project linking three airports (Suvarnabhumi, Don Mueang, and U-Tapao international airports). This project is the first concession granted on a high-speed train project and the largest PPP concession project in Thailand with the value of THB 220,000 million (USD 7.2 billion).
• Representation of the concessionaire of the U-Tapao International Airport and Eastern Airport City in connection with the establishment of regulations for special tax privileges in the Eastern Airport City by formulating a project strategy grounded in proposals from financial experts through a series of negotiations with relevant government authorities to solidify the legal framework and the issuance of regulations for the implementation of special tax privileges around the Eastern Airport City which will significantly enhance the competitiveness of the Eastern Airport City’s development.
• Representation of the government agency for contract management service for the procurement and development of Thailand Genome Sequencing Center under the Genomics Thailand Master Plan. The estimated value of this project is THB 750 million (USD 24 million).
• Representation of the private sector in connection with the drafting, negotiation, and execution of the Engineering, Procurement, and Construction (EPC) agreement for the construction of Thailand’s first monorail transportation, Bangkok’s Yellow Line and Pink Line monorails, with the Mass Rapid Transit Authority (MRTA) of Thailand, having respective estimated valuations of THB 50 billion (USD 1,596 million) and THB 53 billion (USD 1,692 million).
• Representation of the private sector in connection with the bidding processes of the Thailand Privilege Card (TPC) marketing and public relations operations, securing the private sector as the selected concessionaire by the state enterprise, which is the project owner. The TPC project aims for boosting Thailand’s economy by means of attracting foreigners to reside in Thailand.
• Representation of the private sector in the contract management of the project on the development of a THB 3 million (USD 87 million) biorefinery pilot plant as a part of the Eastern Economic Corridor of Innovation (EECi) to establish the first biorefinery capable of operation with GMP and non-GMP standards in Thailand.
• Representation of the private party in the procurement and finalisation of the agreement on provision of overhaul and maintenance of 486 NGV buses for the Bangkok Mass Transit Authority, ensuring smooth and uninterrupted provision of public transportation services for the 3 million passengers in the Bangkok Metropolitan Region.
• Representation of CNNC Joint Venture in contract management of the THB 22 billion (USD 634 million) Lamchabang Port Phase 3 construction and development, contributing as a trade gateway between the Eastern Economic Corridor and the global market with the ability to accommodate containers up to 18 million TEUs per year.

Energy

• Representation of the leading energy company owned by the PTT conglomerate in connection with the load aggregator energy trading business model under the sandbox project of the Energy Regulatory Commission (ERC), which is currently not recognized as a licensable business under Thai law, to advise on contract negotiation and drafting, and development of a business model based on international standards.
• Representation of the leading energy company owned by the PTT conglomerate by exploring the relevant legal regimes, providing risk mitigation plans, and providing feasibility assessment relating to the cross-border trading of renewable electricity across four countries in ASEAN: Laos PDR, Thailand, Malaysia, and Singapore.
• Representation of the government agency in the concession for the development of the Third Phase of the Map Ta Phut Gas Port Project with an estimated value of THB 55,400 million (USD 1.8 billion).
• Representation of PTT Public Company Limited in connection with the transactions of petroleum, oil and gas, and petrochemical products trade.
• Representation of PTT Global Chemical Public Company Limited in petrochemical business operations in respect of the oil and gas trades.
• Representation of a leading indispensable chemistry producer in the restructuring of assets and renewable resources within the group, including issues on licences of solar farms and solar PV rooftop projects, to comply with laws governing energy industry while, at the same time, aiming to excel in green energy investment in Thailand.

State Enterprise

• Representation of a state enterprise in petroleum exploration and production in the procurement process for its internal document and administrative management system upgrade.
• Representation of a member of the PTT conglomerate in the connection with the restructuring of composition of its board of directors and the management under laws governing state enterprise, which differ from the normal corporate governance.

Land Development Project Procurement

• Representation of the leading telecommunication stateenterprises in Thailand, in connection with its project to open bidding for a 50-rai lease agreement for land development project where we assist the client to prepare for its bidding process including drafting of the tender submission guideline, TORs, and other related documents including the draft lease agreement template to be used in the contract negotiation process.

Legislation

• Entrusted by the Government of Thailand, Ministry of Finance, State Enterprise Policy Office (SEPO) with the drafting of the new Public Private Partnership Act B.E. 2562 (2019), governing the development of infrastructure in Thailand.
• Entrusted by the Ministry of Finance, through State Enterprise Policy Office (SEPO), with reviewing the current Public-Private Partnership Act B.E. 2562 (2019) and its subordinating laws (“PPP Laws”), identifying the PPP Laws’ application challenges, proposing practical solutions, and drafting the new amendment to PPP Laws which will align Thailand with international standards and practices, and proposing a guideline for the interpretation and compliance of the PPP Laws which will be adopted nationwide.
